I wonder how this will turn out. It will be interesting for sure - since there is no way to tell who gave who and testing doesn't tell you how long you have or haven't had the diesase.

Any attorney that takes this case is going to have a hellava time PROVING that that man gave her the HPV she has. Testing him to determine that he is a carrier will be next to impossible, determining that she did not contract this through someone else earlier in her life, and have had it dormant in her for a decade or more will be impossible to prove, and so much more. If she has had multiple sex partners that will add another series of unknowns to the equation. Since she does not have cancer, only a virus that her own immune system may deal with in time, and may never develop a serious disease from the virus, she will also have a hard time proving injury, a necessity to have a claim. As to treatments, I would imagine they would be for cancer if she ever gets it since there are no treatments for HPV. What treatments exactly would she like him to pay for ? (I vote for psychiatric) Which begs the question - how does this guy know he had HPV? There is no reliable mechanism to test men for it, and it has no outward symptoms that anyone would have to tell them they were a carrier. This whole thing is lame in so many ways. I have heard some strange things about Kentucky... but that this could end up in the courts there takes the cake.

I agree with you Brian... Working at Planned Parenthood I dealt alot with HPV and like you said it can lay dormant for years..and in this case I think you would have to prove intent to harm ( if in fact you could prove he gave it ) and if she as engaged to be married to him I am sure there was no intent.

Maybe she gave him HPV?!?! My understanding also is that if it is dormant it won't show up in a bloodtest that's why my doctors won't test me for it.

I have HCV - it's been dormant since I was 6 years old (when I had my only blood transfusion). It became active almost 30 years later and has been dormant ever since.

I also had shingles (Herpes Zoster) from chickenpox that I had as a child. It also lays undetectable in the ganglia unless it goes active.

I think it is a shame that people "all over this country" have found it a better idea to sue than deal with there own choices. This is the first I had heard of this. But hey what a breakthough all this would be if it leads someone down a path to find answers to more of these HPV questions. I do think this woman is wasting alot of time though.

I would say certifiable nuts. As Brian said, about the attorney who takes this will have to prove he gave it to her. How can he do this? Gary is probbally correct in stating she may have given it to him. Where will it end? Bill

Hey Dogman,

I work in a pediatric clinic and they are recommending the shots routinely for girls starting at age 11 to 12 (unless they are at especially high risk, then they can have it sooner). There is also now a move toward immunizing boys, too, and my guess is that it would be at about the same ages.
